MAYOR HENRY 'S KLEPTOCRATIC PATRONAGE CRONY CAPITALISM

IS FORT WAYNE’S DEPUTY MAYOR LEGAL?? IF NOT, WERE TAXPAYER DOLLARS IMPROPERLY ALLOCATED FOR HIS SALARY? IF SO, SHOULD THOSE PUBLIC MONIES BE RETURNED TO THE CITY? Indiana Code 36-4-9-7 provides that “The city legislative body may by ordinance establish the position of deputy mayor, who serves as the city executive's deputy. The ordinance must: (1) provide that the deputy is appointed by and serves at the pleasure of the executive; and (2) set forth all the powers of the deputy, which may not exceed the powers of the executive.”
The problem is that there doesn’t appear to be any Fort Wayne Ordinance that establishes the position of Deputy Mayor as required by State law. We have ordinances that establish, define or reference Deputy Inspectors [1], Department of Health Deputies [2], the Deputy Chief of Police [3], Stormwater Quality Control Deputies [4], City Utilities deputy [5], and Deputy Controller, [6]. But not one for Deputy Mayor.
Folks—this is exactly why accountability is soooo important. Fort Wayne began having a Deputy Mayor in 2006 under the Graham Richard administration. However, the salary for the Deputy Mayor had to be approved the year before, in 20015. (For the record, Tom Henry wasn’t even in office as a City Councilman at this point as he had been defeated by Tom Didier.) The State ordinance listed above came to be in the 1980’s.
Perhaps, I am wrong. If anyone can find the local ordinance that I’ve somehow missed that pertains to the Deputy Mayor of the City of Fort Wayne, please post it in the comments section or private message me.
However, if I am not wrong, this begs a series of questions. Such as how does something like this happen?? How did the oversight of this skip two City administrations (Graham Richards and Tom Henry), their assorted City Attorneys, City Controllers, Internal Audit Committees, members of City Council, and the Attorneys who have represented City Council?

  • Robert Enders I'll look it up when I get home, but minor state law violations could be overlooked if the city council moves quickly to change the ordinance. They had illegal use of TIFs in 2007, but nobody went to jail because it got fixed.
  • Gina Burgess Not looking to throw anyone in jail, but rather trying to hold these offices accountable. I've always wondered why we have a Deputy Mayor and not a Chief of Staff and why we have always paid the Deputy Mayor a sum of money that almost matches the Mayor? Keep in mind both our Mayor and...AND....our Deputy Mayor get paid more than the Mayor of Indianapolis and the Governor of the State of Indiana.

  • Kenneth White Jnr What do you wanna bet that "But it is the functioning comparable rate of pay for a CEO in charge of 250,000 employees" would probably be their first line of defense on the salary cap issue, which means they regard the average citizen as either cattle or slave labour. You think that's bad, look at Wendy Robinson's (FWCS Super) pay and benefits then come back and whine about our Mayor and Deputy Mayor getting paid to much would be their second line of defense.
  • Gina Burgess Right now, my focus isn't so much on how much these guys are getting paid, but rather if we have been paying the Deputy Mayor illegally. Using taxpayer money to fund a position that does not legally exist?? I agree with Joe Renner in that this may be another new level of wrong. In any event, can anyone prove me wrong here.
  • Gina Burgess You know Kenneth White Jnr -- If I wanted to make this matter exclusively about pay, then you are right. The powers that be would try to equate running a city like running a corporation. And honestly, that would be a fair assessment. But let's also keep in mind that the City, per its own stats, has about 2,000 employees. There's a difference between employees and tax-paying citizens. So how are you thinking this applies? Please read section (b) of the statute you provided and then read how it applies to section 13 through 17.   • Karen Walker Gina, Don't have any more time now to thoroughly research this. I.C. 36-4-9-7 on appointment of Deputy Mayor appears to be a permissive statute, not mandatory. "The city legislative body MAY by ordinance establish the position of deputy mayor." Also home rule allows lots of leeway in what cities do. I.C. 36-1-3 et.seq. City Code 30.01 A 8 establishes the Executive Office of Mayor headed by "Director of Staff" and spells out the duties of the position, which sounds like the Deputy Mayor position. Maybe the Deputy Mayor is just misnamed and should be called Director of Staff. Frankly, I don't see this as much of an issue compared with other problems we need to address.

  • Karen Walker I'm as much as a rule follower as anyone. However, again, I really don't see the big deal with the police department pensions either. It involved only two officers who got their own pension payouts in a different than normal manner. It is now fixed by Ordinance. Adam Widener constantly blows little things out of proportion in an apparent attempt to catapult himself into a better job, so far, with no success. As a possible future member of City Council, we need to focus on important things that make a real difference to City residents. Although, I must add that the biggest messes right now are being created by the State Legislature of which City Council has no control.

Police offers should not be allowed to pick and choose which rules they get to follow anymore than the regular citizen does. The same goes for political candidates and elected leaders.     Nepotism and Patronage; and so on- are nothing new to any city politics anywhere across the USA. "everyone does it"- is it right? well- It doesnt pass most citizens "smell test". As ShaKespeare's Hamlet might Quip- Something stinks in Denmark.

I see nothing but political patronage..Im sure Mayor Henry isnt the brightest bulb in the marquee- so Mr bandemer and Win Moses are running a shadow government out of the re development commission; and other city departments..-like- Hey Mayor Henry- you go dophot ops- read to kids, hand out check s to the homeless; cut ribbons, dig holes at ground greakings, and so on- put a happy smiling face on the OLD WARTHOG OF A CITY- and well Loot the Treasury Vault and the Legacy Cash cow; ; and youll have Plausible deniability...
